European Arrest Warrant and Criminal Proceedings in Connection with Call Centers – Extradition to Germany

The European Arrest Warrant (EAW) is a European Union legal instrument for the surrender of persons between the member states of the European Union. It serves the purpose of criminal prosecution or the execution of a legally binding custodial sentence or detention order.

In recent years, Bulgarian courts have repeatedly ruled on the execution of European Arrest Warrants issued in connection with the activities of so-called "call centers". A significant portion of these warrants was issued by German judicial authorities within the framework of investigative proceedings concerning organized investment fraud, cybertrading fraud, fraudulent online trading platforms, and other cross-border property offenses. 

The proceedings affect both suspected organizers of such structures as well as employees, call center agents, and other participants. Depending on the circumstances of the individual case, complex legal questions arise regarding the admissibility of extradition, the protection of the requested person's procedural rights, and potential grounds for refusing the execution of the European Arrest Warrant.

Early legal consultation by a lawyer experienced in international criminal law and the law of the European Arrest Warrant is therefore of crucial importance. Only in this way can the rights of the person concerned be effectively protected from the very beginning of the proceedings and an appropriate defense strategy developed.


It is equally important to note that going underground or attempting to evade the execution of a European Arrest Warrant is generally not a viable solution and can even significantly worsen one's personal legal situation.

Even if a European Arrest Warrant contains allegations of serious criminal offenses and mentions prison sentences of up to 15 years, this by no means implies that a corresponding conviction has already been decided. The European Arrest Warrant serves exclusively for the purpose of extradition or surrender to the requesting member state. The actual criminal proceedings, during which guilt or innocence as well as any potential sentence will be determined, take place solely in that state.
Precisely for this reason, it is of particular importance that the defense already during the extradition proceedings is handled by attorneys who possess comprehensive experience with European Arrest Warrant proceedings, international investigations, and cross-border criminal cases, and who can demonstrate practical success in similar proceedings.
